Terms of Service
These Terms of Service ("Terms") govern your access to and use of & Senibina and all associated services, including our reference databases, software tools, and APIs (collectively, the "Service"). & Senibina is operated by & Senibina Pte Ltd, a company registered in Singapore (UEN: 53484043D).
By accessing, registering for, or using & Senibina, you ("you" or "User") agree to be bound by these Terms. If you do not agree to all Terms, you may not access or use the Service.
1.Acceptance of Terms
TL;DR: By using & Senibina, you agree to these terms. If you represent a company, you confirm you have authority to bind that company.
If you access & Senibina on behalf of a company or organization, you represent and warrant that you are authorized to accept these Terms on that entity's behalf, and that entity shall be bound by these Terms.
We may update these Terms from time to time. Material changes will be notified 30 days in advance via email and website notification. Continued use after the effective date constitutes acceptance.
2.Data Protection & Privacy (PDPA Compliance)
TL;DR: We comply with Singapore's PDPA. Your data is protected, you can request access/correction, and we notify you of any breaches.
& Senibina is committed to protecting your personal data in compliance with Singapore's Personal Data Protection Act (PDPA).
2.1 Ten PDPA Obligations
Notification: Before collecting personal data, we notify you of purposes via our Privacy Policy and registration forms.
Consent: We only collect, use, or disclose your personal data with your consent. You may withdraw consent at legal@senibina.com.sg with reasonable notice.
Purpose Limitation: We use your data only for consented purposes including: providing and improving the Service, responding to inquiries and support, conducting research and analytics (aggregated, non-identifying), complying with legal obligations, and preventing fraud or security threats.
Accuracy: We make reasonable efforts to ensure data accuracy. Request corrections at legal@senibina.com.sg.
Protection (Security): We implement reasonable security measures including encryption in transit (HTTPS/TLS 1.2+), encryption at rest for sensitive data, access controls and authentication, employee training and data protection policies, and regular security testing and incident response.
Retention Limitation: We retain personal data only as necessary: Account information while active (deleted 30 days after termination), Analytics data for 12 months (then aggregated/anonymized), Support records for 3 years (dispute resolution), Billing information for 7 years (legal/tax requirement).
Access & Correction: You may request access to or correction of your data at legal@senibina.com.sg. We respond within 30 days.
Openness: Our policies are disclosed in this Terms of Service and our Privacy Policy.
Accountability: & Senibina is responsible for PDPA compliance. Data Protection Officer contact: legal@senibina.com.sg
Data Breach Notification: In case of breach, we will notify affected individuals within 30 days, notify PDPC if breach affects public interest, provide breach details and remedial steps, and not blame individuals for the breach.
3.Disclaimers for Government Regulatory Information
TL;DR: We provide reference information about Singapore government regulations, NOT official government documentation. Always consult qualified professionals and official sources before making decisions.

3.1 Professional Advice Disclaimer
THIS SERVICE DOES NOT PROVIDE PROFESSIONAL, LEGAL, ENGINEERING, ARCHITECTURAL, OR REGULATORY ADVICE.
The information on this Service is NOT a substitute for:
- Consultation with qualified professionals (licensed architects, engineers, Qualified Persons [QPs])
- Direct consultation with Singapore government agencies

While reasonable efforts have been made to ensure accuracy, errors and omissions may occur. The Service is provided "AS-IS" and "AS-AVAILABLE" without any implied warranties.
3.3 No Liability for Consequences
& SENIBINA SHALL NOT BE LIABLE FOR ANY LOSSES, DAMAGES, OR CONSEQUENCES arising from your use of, reliance on, or inability to use information on this Service.
This includes but is not limited to:
- Building code or regulatory non-compliance
- Failure to meet statutory requirements
- Project delays, cost overruns, or abortive works
- Fines, penalties, or enforcement action by authorities
- Loss of building permits or approvals
- Professional or financial damages
- Injury, property damage, or safety incidents
- Loss of profit, revenue, business opportunity, or goodwill
- Any other direct, indirect, incidental, special, or consequential damages
This applies EVEN IF we were advised of the possibility of such damages.
3.4 Government Agency Disclaimer – No Official Status
& Senibina IS NOT:
- An official government agency
- Endorsed or approved by Singapore government agencies
- A publisher of official regulatory documents
- A substitute for government agency consultation
This Service provides REFERENCE INFORMATION based on publicly available government sources. The data we provide is our compilation and interpretation of government regulations, may contain errors or omissions, is NOT official government documentation, and must NOT be relied upon as the definitive statement of requirements.

3.5 Data Freshness & Update Disclaimer
Regulatory requirements change frequently. & Senibina makes reasonable efforts to maintain current information, but we CANNOT GUARANTEE that all information is current or complete.
USERS MUST VERIFY all information with official government sources BEFORE making design or construction decisions, submitting regulatory applications, making compliance determinations, or relying on information for any material decision.
4.Intellectual Property Rights
TL;DR: We own our software and platform. You own your data. Our reference databases are licensed under Creative Commons BY 4.0 (free to use with attribution).
4.1 & Senibina's Intellectual Property
& Senibina and its licensors own all right, title, and interest in: the Service (including all software, code, and applications), the & Senibina platform, website, and user interface, all features, tools, algorithms, and processes, all documentation, guides, tutorials, and training materials, the & Senibina brand, logo, trademarks, and service marks, all compilations, databases, and their organization/structure, all improvements, modifications, or enhancements, and any derivative works or modifications.
All intellectual property rights are reserved.
4.2 Customer Data Ownership & License
Customer Data Retention: You retain all ownership and intellectual property rights in data you upload, create, or input ("Customer Data"). This includes project files and models, design drawings and specifications, compliance documentation, and custom configurations or workflows.
License Granted to & Senibina: You grant & Senibina a worldwide, non-exclusive, royalty-free license to use, store, copy, process, modify, and back up your Customer Data for purposes of providing the Service to you, improving and optimizing the Service, creating aggregated, anonymized analytics (non-identifying statistics), and complying with legal obligations.
Data Deletion: Upon your request or account termination, we will delete your Customer Data within 30 days (except where legally required to retain).
4.3 Reference Database License – Creative Commons Attribution 4.0
The & Senibina reference databases (free tier), including the IFC-SG Parameter Reference Database and regulatory parameter databases, are licensed under Creative Commons Attribution 4.0 International (CC BY 4.0):

What You Can Do:
- Share: Copy and redistribute in any medium or format
- Adapt: Remix, transform, and build upon for any purpose, including commercially
- With the only requirement: Give appropriate credit to & Senibina and link to CC BY 4.0
Attribution Requirements:
When using CC BY 4.0 reference data, you must:
- Credit & Senibina as the original creator
- Provide a link to https://creativecommons.org/licenses/by/4.0/
- Indicate if you've made changes
Attribution Example:
"This reference database is based on the & Senibina IFC-SG Parameter Reference Database (https://senibina.com.sg), licensed under Creative Commons Attribution 4.0 International (https://creativecommons.org/licenses/by/4.0/). [Describe changes made, if any]."
What This License Does NOT Cover:
- & Senibina proprietary software and applications
- Customer Data (belongs to you)
- The & Senibina trademark or brand
- Paid tier services and features
5.Acceptable Use Policy
TL;DR: Don't use our service for illegal activities, security threats, reverse engineering, or building competing products.
You agree NOT to use & Senibina for:
Illegal Activities
- Using the Service for illegal purposes or violating laws
- Transmitting, storing, or processing content that violates laws
- Facilitating money laundering, fraud, or criminal activity
Intellectual Property Violations
- Infringing third-party copyright, trademark, or patent
- Distributing pirated or unlicensed software
- Violating open-source software licenses
Security Threats
- Attempting to gain unauthorized access to & Senibina systems
- Hacking, cracking, or probing security vulnerabilities
- Transmitting viruses, malware, worms, or harmful code
- Conducting denial-of-service attacks
Reverse Engineering
- Reverse engineering, decompiling, or disassembling the software
- Attempting to derive source code or underlying algorithms
- Circumventing access controls or copy protection
Excessive Use / Resource Abuse
- Making automated requests without authorization
- Web scraping or mass downloading of content
- Using the Service to build a competing product
- Extracting data at volumes exceeding fair use
Resale / Commercial Redistribution
- Reselling or sublicensing the Service without authorization
- Redistributing & Senibina software without a license
- Charging others for access to & Senibina services
6.Warranties & Limitation of Liability
TL;DR: Service is provided "as-is" without warranties. For paid users, liability is capped at fees paid in the prior 12 months or SGD 5,000 (whichever is less). Free users: SGD 0 liability cap.
6.1 Warranty Disclaimers
& SENIBINA PROVIDES THE SERVICE "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
We specifically disclaim:
- Any implied warranty of merchantability
- Any implied warranty of fitness for a particular purpose
- Any implied warranty of title or non-infringement
- Any warranty that the Service will be uninterrupted, timely, or error-free
- Any warranty that defects will be corrected
- Any warranty that the Service or servers are free from viruses or harmful code
If you use & Senibina, you assume all risks. & Senibina assumes no liability for your use of or inability to use the Service.
6.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY SINGAPORE LAW, IN NO EVENT SHALL & SENIBINA, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:
- Direct damages or losses
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, or business opportunity
- Loss of data, files, or information
- Loss of goodwill or reputation
- Cost of substitute services
- Any damages arising from your use of or inability to use the Service
This applies EVEN IF we were advised of the possibility of such damages.
Liability Cap
Paid Tier: & Senibina's total aggregate liability shall not exceed the LESSER OF: the fees actually paid by you in the 12 months preceding the claim, or SGD 5,000.
Free Tier: & Senibina's liability is limited to SGD 0.
Exceptions
These limitations do NOT apply to:
- & Senibina's willful misconduct or gross negligence
- & Senibina's fraud or fraudulent misrepresentation
- Indemnification obligations
- Any matter where limiting liability would violate applicable law
7.Termination
TL;DR: You can terminate anytime. We can terminate for Terms violations. Your data is deleted within 30 days of termination.
7.1 Termination by You
You may terminate your & Senibina account at any time by deleting your account through account settings or sending written notice to legal@senibina.com.sg.
Upon termination:
- Your account will be deactivated
- You will lose access to all services
- Your Customer Data will be deleted within 30 days (export data before deletion)
7.2 Termination by & Senibina
& Senibina may terminate your account immediately for:
- Violation of these Terms of Service
- Illegal activities or violation of law
- Non-payment (paid tier customers)
- Security threats or unauthorized access attempts
- Abuse of the Service
- PDPA violations or data protection violations
7.3 Effect of Termination
Upon termination:
- Your license to use the Service terminates
- You must cease all use of the Service
- Your Customer Data will be deleted within 30 days
- Sections that should survive termination remain in effect (IP ownership, limitation of liability, indemnification, etc.)
8.General Terms
TL;DR: Singapore law governs. 30-day notice for material changes. Disputes resolved through negotiation, then Singapore courts.
8.1 Governing Law & Jurisdiction
These Terms are governed by and construed according to the laws of the Republic of Singapore, without regard to conflicts of law principles.
Both you and & Senibina irrevocably submit to the exclusive jurisdiction of the courts of Singapore for any dispute arising out of or relating to these Terms or the Service.
8.2 Modifications to These Terms
& Senibina reserves the right to modify these Terms at any time.
Notice Requirements:
- Material Changes: 30 days' notice via email and website notification
- Minor Clarifications: Updated terms effective immediately upon posting
How Changes Become Effective:
- We will update the "Effective Date" at the top of these Terms
- Continued use of the Service after the effective date constitutes acceptance of the updated Terms
Your Rights:
- You may terminate your account if you disagree with material changes
- Termination must occur before the effective date of changes
8.3 Dispute Resolution Process
If a dispute arises, the parties agree to:
Step 1: Good Faith Negotiation (Days 1-30)
Either party may initiate by written notice. Representatives attempt in-person or video meeting. Both parties act in good faith to resolve.
Step 2: Mediation (Days 31-60, optional)
If negotiation fails, either party may propose mediation. Mediator mutually agreed or appointed by Singapore Mediation Centre. Costs split equally. Confidential.
Step 3: Litigation
If mediation fails, either party may file in Singapore courts.
